1. Our position

DARK is a commerce platform. The stores hosted on it are created and operated by independent merchants, and merchants are contractually required to own or license everything they publish and sell. We do not permit counterfeit goods, brand impersonation, or the unauthorized use of copyrighted works or trademarks, and we screen store names and domains against well-known marks at creation time.

When we receive a valid notice, we act quickly: the specific content or store is taken offline, the merchant is notified and given the chance to respond, and repeat infringers lose their account.

2. Reporting copyright infringement (DMCA notice)

If you believe a store on our platform infringes your copyright, send a notice containing the elements required by 17 U.S.C. §512(c)(3):

  • identification of the copyrighted work you claim is infringed;
  • the URL(s) on our platform where the infringing material appears;
  • your name, organization (if any), email address, and physical address;
  • a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law;
  • a statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner (or authorized to act for the owner) of an exclusive right that is allegedly infringed;
  • your physical or electronic signature.

3. Trademark, counterfeit and impersonation reports

Reports about counterfeit products, unauthorized use of a trademark, or a store impersonating your brand do not require the DMCA format — use the same form and include your registered mark (registration number where available), the URL of the store, and a short description of the impersonation. Counterfeit and phishing reports are prioritized and typically actioned within one business day.

4. Counter-notification

If your content was removed following a copyright notice and you believe the removal was a mistake or misidentification, you may send a counter-notification to [email protected] containing: identification of the removed material and its former location, a statement under penalty of perjury that you have a good-faith belief it was removed by mistake, your name, address, and consent to the jurisdiction of your federal district court (or any judicial district where DARK may be found, if outside the US), and your signature. Unless the original claimant files a court action, removed material may be restored in 10–14 business days.

Knowingly false notices and counter-notices carry liability under 17 U.S.C. §512(f). We reserve the right to reject and, where appropriate, respond to fraudulent or abusive notices.

5. Repeat infringers

We maintain and enforce a repeat-infringer policy: merchants who receive multiple substantiated notices have their stores suspended and their accounts terminated. Every notice, action, and response is logged.
